"K9Home" is a trademark and brand operated by K9 Home LLC, a Washington limited liability company headquartered in Kirkland, Washington ("K9Home," "we," "us," or "our"). Welcome to K9Home. By accessing or using our mobile application and related services (collectively, the "Service"), you agree to be bound by these Terms of Service.
Beta Service: The Service is currently offered as a pre-release beta version for testing and evaluation purposes only. The Service may contain errors, defects, or inaccuracies, may be modified or discontinued at any time without notice, and features available during the beta period may change or be removed in any commercial release.
Fees During Beta: Access to the beta Service itself is free. K9Home charges a service fee on transactions completed through the Service, at the rate disclosed in the app before you complete the transaction. Fee rates, caps, or promotional discounts offered during the beta period apply only to the beta period and do not guarantee the same pricing after commercial release; K9Home may change its fee structure upon commercial release, with notice to users.
Beta Data: Any data, estimates, projects, bids, or account information created during the beta period may be modified, reset, or permanently deleted at the end of the beta period or at any time during it. You are responsible for retaining your own copies of any information you wish to keep.
Feedback: If you provide suggestions, bug reports, ideas, or other feedback regarding the Service ("Feedback"), you grant K9Home a perpetual, irrevocable, worldwide, royalty-free license to use such Feedback for any purpose without compensation or attribution.
Suspension of Beta Access: K9Home may suspend or terminate your access to the beta Service at any time, for any reason, without notice or liability.
Estimates Are Informational Only: The Service generates construction cost estimates based on your spatial measurements, your project selections, and K9Home's proprietary pricing and estimation methodology. While we strive to make estimates as accurate and current as possible, all estimates are provided for informational and planning purposes only. Estimates are NOT quotes, bids, appraisals, or guarantees of actual construction costs.
Actual Costs Will Vary: Actual project costs depend on site conditions, structural discoveries, material availability, market price fluctuations, contractor pricing, permit requirements, and other factors that cannot be determined through the Service. Actual costs may differ materially from any estimate generated by the Service. You should obtain formal written bids from licensed contractors before making any financial decisions or commitments.
Measurement Accuracy: Spatial measurements generated through the Service (including AR- and LiDAR-based measurements) are approximations and should not be relied upon for construction, engineering, permitting, or purchasing decisions. Verify all measurements independently before use.
K9Home Is a Platform: K9Home provides a technology platform that enables homeowners to generate cost estimates and connect with independent contractors. K9Home is not a general contractor, construction company, engineering firm, or appraiser, and does not perform, supervise, or manage any construction work.
Independent Contractors: Contractors on the Service are independent third parties, not employees, agents, or partners of K9Home. Any contract for construction services is solely between the homeowner and the contractor. K9Home is not a party to, and assumes no responsibility for, any such contract, including work quality, timeliness, pricing, warranties, or disputes.
License Verification: Where the Service displays contractor license or registration information, such information is obtained from government or third-party sources and is provided for convenience only. K9Home does not guarantee its accuracy or currency and does not endorse, recommend, or vouch for any contractor. You are responsible for independently verifying any contractor's licensing, bonding, insurance, and qualifications.
Disputes Between Users: You release K9Home from any claims, demands, and damages arising out of or connected with disputes between homeowners and contractors.
Your Responsibility: You retain ownership of any photos, images, text, or other content you upload to the Service ("User Content"). You represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to post your User Content.
Prohibited Material: You agree not to upload content that infringes upon third-party copyrights, trademarks, or privacy rights. You assume all legal liability for any copyright infringement resulting from User Content you upload.
License Grant: By posting User Content, you grant K9Home a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute your content solely for operating, promoting, and improving the Service.
Zero Tolerance for Objectionable Content: K9Home has zero tolerance for abusive, harassing, threatening, hateful, obscene, or otherwise objectionable User Content or conduct. K9Home reserves the right, in its sole discretion, to remove or disable access to any User Content, and to suspend or terminate the account of any user, that violates this policy or these Terms, at any time and without prior notice.
Reporting Objectionable Content: If you encounter objectionable User Content or abusive behavior from another user, please report it to support@k9homebid.com. We will review reports promptly and take appropriate action, which may include removing content, warning the user, or suspending or terminating the offending account.
K9Home respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). We reserve the right to remove or disable access to any content alleged to be infringing without prior notice. Fees: K9Home charges service fees on transactions completed through the Service. The applicable fee is disclosed before you complete any transaction. Payments are processed by third-party payment processors (currently Stripe); K9Home does not store your full payment card details. Your use of payment processing is also subject to the processor's terms.
No Refund of Platform Fees: Except where required by law, platform fees are non-refundable once contractor contact information has been released or the corresponding service has been delivered. Fee disputes must be raised within thirty (30) days of the charge.
The Service and all User Content are provided "AS IS" without warranty of any kind. K9Home does not endorse, guarantee, or assume responsibility for any User Content posted on or through the Service.
To the maximum extent permitted by law, K9Home and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or property value, arising out of or related to your use of the Service, any estimate generated by the Service, or any interaction or contract with any contractor, whether based on warranty, contract, tort, or any other legal theory, even if K9Home has been advised of the possibility of such damages. In no event shall K9Home's total aggregate liability exceed the greater of (a) the amounts you paid to K9Home in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in King County, Washington, and you consent to the personal jurisdiction of such courts.
K9Home may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
